2 years ago I bought a home which my significant other at that time and I were going to live in. I cashed my retirement fund in for the downpayment and closing costs and the house was to be in my name only. During this process I was called out of state because my Mother was very ill, during my visit with her she passed away so I was away longer then expected. My significant other was handling the final paperwork for me (he and I are both Real Estate Agents) so I felt comfortable with him handling this. Shortly after my return home we went to closing on the home...at that time I saw his name on the papers and questioned that. He claimed it was "safer" to have 2 names and once things settled his name would be removed and my daughters added. Of course that never happened, now the relationship is over and he wont sign anything to remove his name. Is there anything I can do at this point? He also wont leave the home and doesnt pay for the mortgage. What can I do?

As the other person's name is on the property deed, he'll be considered as one of the owners of the property. Unless he signs a quit claim deed and removes his name from the property, he'll remain one of the owners of the property. He will be able to stay in the property though he doesn't pay the mortgage dues. You can buy him out by offering a certain sum of money and ask him to transfer the property deed in your name.
