removeing name off mortgage

I am a co borrower on the mortgage with my husband. The title is in his mothers name and she also quit claimed his name on it. I am not on anything EXCEPT the mortgage. I want off the mortgage to as I feel I own nothing. I have helped pay the mortgage and remoldleing also.We have not been able to file any taxes for improvements for the last 14 yrs as she just quit claimed it 4 yrs ago. Whats the best way on can get off it. Do I need to file for divorce?
While the situation is somewhat different, I too have a similar issue which I need answered. Divorce has not been the solution as we are seemingly unable to have my fiancee's ex wife's name removed from the mortgage without refinancing, which chase bank is not willing to do. This has created a great deal of complications. So all I can offer to you is that divorce may not be a solution for you.

i don't think that you will have to file a divorce in order to remove your name from the mortgage docs. however, as you are a co-borrower of the loan, i don't think it will be easier for you to remove your name from the loan. you will have to speak to the lender regarding this and if the lender agrees, then the primary borrowers can refinance the loan in their name.

lenders generally ask to refinance the mortgage if you want to remove a person's name from the mortgage. however, there is another process called novation which can also be followed to remove a person's name from the mortgage docs. you can speak to the lender about this. but you should remember that lenders prefer refinance over novation.

I am filing for divorce and can not refinance... how do I get me soon x too be off the mortgage if he agrees.

Hi Brenda,

A quitclaim deed can help you remove your soon to be ex off the title, but in order to get him off the mortgage a refinance is required. If you are unable to refinance you can try and negotiate with the lender and do a Novation agreement to replace him from mortgage.
