Only a Judge can do it, and he's going to want a really good reason. A person missing for a year doesn't sound like a good reason to me ... she could be backpacking in Canada, and might be gone for another year. It's a different story if you think she's no longer alive, but you're going to have to show/prove it to the Judge.
