Keeping the kids, not the house

Posted on: 13th Apr, 2010 09:02 pm
My husband and I bought a house together. In the meantime we separated and he now lives in the house and pays the mortgage. I live in another town and no longer want anything to do with the house. Is there any way I can get my name off all paperwork including the mortgage payment so I can buy a mobile home on my own? I cannot qualify for a mobile home as long as my name is on the other home. Thanks for listening!
Hi Debbiemiller,

You can sign a quit claim deed and remove your name from the property deed. However, if you want to remove your name from the mortgage documents, then you'll have to ask your husband to refinance the loan in your name. If he doesn't do so, you would remain liable for the mortgage payments.

Thanks
