Mother in nursing home

Posted on: 17th Feb, 2010 10:02 am
My mother has been recently admitted into a nursing home. She is 84 years old. She now only gets about $50 a month from her SSI check and the rest goes towards the health care nursing home expenses. The house she used to live in has her name and my brother's name on the title. My brother and his family still live there in the house. My mom can no longer make the house tax payments. Can her name be removed and my brother's son's name be added to it. In otherwords, my brother will need to take over the house tax payments.
essentially, your brother is going to have to assume that tax liability no matter what. removing your mom's name isn't necessary. you're going to want to look into what effect that would have on whatever benefits she may be able to receive while she is in the nursing home. home ownership is, i believe, one of the things considered when an elderly person is seeking benefits of any sort, and even at the time when becoming housed in a nursing home.

i hope that someone with expertise in elder law might be viewing this thread and jump in and provide us with some insight.
