removing a party off title

Posted on: 03rd Feb, 2009 09:45 am
HI:
I would like some advice on removing a person off title.Im the only one on the loan. She claims that its her house, and that i should move out,but its my credit on the line.we both make payments but she wants me to pay her back for tha time she lived there.i dont know what to do.
hi,

you have mentioned that your name is on the loan and she claims that the house is hers. but i would like to know if her claim has any legal base to stand on? did you quitclaim your share in the property to her? if you did, then she is the legal owner of the house. but, even then, you cannot move out of the house without paying the loan off.

if you really want to move out, then get a written confirmation from her that, after you move out, she will refinance the house in her name which will allow you to pay off your debt. as far as her claim to pay her back for the time she spent in the house, it does not seem to have any legitimate and legal leg to stand upon. and if you did quitclaim the title to her, and now want her name to be removed off the title, then you will have to reverse the quitclaim by proving that the deed was invalid, for which you can always take the help of an attorney.

please do not hesitate to post further queries.

take care & be happy

god bless you.
