My husband has been evicted by police PFA for over one year. Unemployed for over 2-3 years. I have paid mortgage directly from my checking account for well over 2-3 years. I am now filing for bankruptcy - do I have to give im 1/2 of any residual monies from sale of the house?

By legal terms if his name is on the deed and does have 50 % stake then you need to give 1/2 of the proceeds to him after selling the property.

If your spouse's name is mentioned on the property deed, then he'll be considered as one of the owners of the property. Thus, when the trustee sells off your property to pay off your creditors, your spouse will receive his share of the property from the sale proceeds.

You should consult an attorney about this. You don't mention if you are legally separated or otherwise in the divorce process, which can significantly impact what your spouse is entitled to. In some states, spousal behavior is reason enough not to give him one red cent. Since none of the people in this forum are, as far as I know, licensed attorneys, they shouldn't be giving out legal advice.

This can not be 100 % true,whereas nobody is here to give false advice to another person.Although person may not be able to give legal advice but surely he can give general advice based on his experience.
