Wife dies and husband not on deed

My wife purchased the house before we married. We have been married for 15 years and have a 7 year old son together (only child). However, we never put the house in both of our names still in her maiden name. Now, my wife has passed away how do I put the deed in my name.

Is your wife signed any will which containing your names & she recorded it. If she signed it you will be owner of this property. There is no option to loose property.

If She did not signed will then you or your child will be the owner of property. Because you both will be the beneficiary of her property. Attorney will help you to get ownership of the property.

Hi ortolon,

As your name is not on the property deed, you will have to file an affidavit of heirship and transfer the property in your name. You'll also have to submit your wife's death certificate at the county recorder's office.

However, if your wife had a will, then that will needs to be probated. Once the probate is complete, the property will divided according to the will.
