Do I need a lawyer

Posted on: 28th Aug, 2010 10:32 am
My mother died 5 years ago and her house is in her husband, (limited intelligiance) for 1/2 and then me and my 2 sisters own the other half. According to the deed he is responsible for taxes, home owners insurance, heating bills, collecting rents etc. He has not paid the taxes in over 3 years, and my sisters and myself are paying home owners insurance for 5 years now to protect ourselves as he has crack addits and the likes coming and going in this home. The house has been raided more than once and he has gone to jail. We hired an attorny who was suppose to start a partition action and paid him $5,000. I just heard from this lawyer over a year later and the city of New York is suing for $16,000
for lack of heat to tenant upstairs and asked us to settle this for $1,600. I said No as this parasite would think the heating bill is now our responsibility. I want to get my name off this deed but my share of house would go to this person who is no doing his part of the deed. How do I go about this as I too have a limited income and my one sister is fighting Cancer for 5 years? He stuck my sisters and I with the cost of my mother's funeral even though he collected $35,000 in life insurance. I think you can see what type of person we are talking about. My mother supported him for over 25 years.
Hi georgette,

If you have a written document stating that your mother's husband would be liable for taxes, home owners insurance, heating bills, collecting rents, etc., then you can take legal actions against him if he is not paying the dues. You can contact an attorney and he would help you in filing a lawsuit and help you in taking legal actions against him.

You can transfer your share of the property to your sisters rather than to your father if you want to get rid of the ownership of the property.

Thanks
