my husband and i bought a house using 100% the profit from the sale of our previous home. at the time of the new purchase my husband convinced me he could get a better loan by purchasing the property only under his name, since he had a higher credit rating. I relinquished my right to the property and the lender gave his the house "as his sole property". I have solely paid the monthly mortgage payments from my salary. The mortgage is payed automatically from my own account. My husband never added me to the title since he said we had everything covered with our living trust. According to him our living trust has a provision that includes all properties and assets we obtain even if we don't include them manually. Both my husband and I are trustees of the living trust. We are now facing a divorce. Do I have any rights to this property. My husband said i do not since my name is not on the deed. Please reply ASAP. Hope this is the right forum to post this question.

In my opinion you have to sue him in court by taking help of your lawyer if its possible.

you are staying in which states? if it is a community state, you are coowner of property. otherwise you consult attorney with all the facts & proofs

You've mentioned that you've relinquished all your rights to the property by signing a property deed. Thus, you do not have any rights to the property and I don't think you will be able to claim any interest in that property. However, I would still suggest you to contact your attorney and take his opinion in this regard as you've paid the mortgage dues from your salary.
