hi. i am not sure what to do. 9 years ago i divorced and in our propertry agreement i gave up my rights and interest of our mobile home to my ex-husband. it also stated in the agreement he was responsible for all future payments. after all these years he just stopped making payments. of course the mortgage company starting calling me for payment since my name is still on the loan. my question is since i didn't sign a quit claim deed do i still have rights to the mobile home. he has agreed to give the trailer back to me if i take over the payments. i'm just not sure how to legally do this. please help!

I can help you by giving my suggestion.

Here you both already divorced so now you are separated persons who not bind with any relation. So i would like to advice you that, There your name in loan agreement so mortgage company calling you for the payment, but here is mortgage company is have rights to call you for payment because you are cosigner of the mortgage loan.

You need to discuss with your divorced husband about that. Now he is the owner of that property so he is responsible to pay the payment of mortgage. Now this is not your property to pay the payments, You can get help of Mortgage company about that you can give them divorce certificates so you are not responsible to pay them.

Other one legal way is, Take to your husband in court for this case . They will help you.

Welcome to forums!

As your name is still on the mortgage docs, you'll will be held responsible for the payments as he has defaulted the mortgage payments. As you did not sign the quitclaim deed to transfer the property in his name, you still have ownership rights to the property.
