Executor of Trust - agreement

Posted on: 28th Jan, 2009 11:03 am
As an Executor and beneficiary as well of a Trust/Will who makes the final decision? Do all beneficiaries need to agree on the sale of a home?
Hi Guest!

Welcome to forums!

Whether the executor can sell the property or not without informing the beneficiaries will depend upon the will. If the deceased person gives a particular asset to a specific person, then the executor will not have the right to sell it. However, if the will simply directs that the executor should divide the estate, then the executor might have every right to sell the property without the consent or knowledge of the beneficiaries.

Feel free to ask if you have further queries.
