Can a piece of property be sold without your consent if you have an interest in it?...I put down 15% on a piece of property, in Tennessee, at auction $28,000 to be exact. My sister passed away a few days later in Louisiana. My Mother who was in failing health did not take it very well. I contacted the bank ( whom the property belonged to the President's deceased parents) and told them I didn't think I could go through with it at that time. She ( the president) said we will put it into your daughter's name and set a close. I expressed my concerns about it but they continued. Making me believe I had no other chose. It was closed on and because of trying to maintain two homes 14 months later was on the verge of foreclosure. The bank contacted me and I was able to borrow the money to catch it up. Again nine months later it was behind and without my knowledge they went to my daughter and had her to sign a deed-in-lieu giving them the property back. Giving me no opportunity to catch it up. And when I called they said I could get no information because I was not on the account. I did not sign a quitclaim for my down payment. Do they owe this back to me? Can I put a lien on this property for my $28,000. Help! Please!

Was your name also on the property deed? I guess it wasnt. The property was in the name of your daughter and she had already quitclaimed the property. In that case, I dont think you will hardly have a chance to get back whatever you owed. But still you can consult an attorney and see if you can take any steps against them.

Can someone put a lien on a house that is owned jointly who are separated

Welcome Louie,

Yes, as far as I know, a creditor can put a lien on the property if you are not paying him. It will not matter if the owners of the property are separated.

rlabat: you should consult with an attorney right away. You may have a case against the bank.
