CAn ex sell house if we are both on the deed?

I bought a house with my now ex fiance. We have two children. I have lived alone in the house with the children since January of 2009. I have made all the house payments with no help from him. I've asked him sveral times to sign a quit claim, but he refuses. We are both on the mortgage and deed. I have since filed taxes and claimed the property tax. Is he intitlted to any of the money? Can he try and sell the house with out my consent? Can I sue for his half of mortgage payments since he refuses to remove his name from the deed?Live in California

As your ex-husband's name is on the property deed, he will be able to claim ownership of the property. However, he won't be able to sell off the property without your consent as you too are one of the owners of the property. You may be able to sue him but it would be better if you could offer him a certain sum of money and ask him to sign over the property deed to you.
