remove my name

Posted on: 12th Mar, 2009 05:19 pm
After my husband and I married, he wanted to live in his house until the kids finished school. He added my name to the deed. I am on the mortgage now because we had to reinfiance. I have good credit. I found out he had some judgements on the mortgage. I want my name off his house. I don't want my credit ruined. Can I sign off on this house?
Hi Jet,

As you are on the title to the property, you need to sign a quit claim deed to remove your name from title. But a quitclaim won't relieve you of your mortgage liability. Your husband needs to get it refinanced in his name to take your name off the loan. You can also request the lender to remove your name from loan once you quitclaim your interest.
