Divorce -taking the wife off

My wife and I are divorcing and we are in the process of doing the divorce papers through legalzoom.com. The home is in both names as is the loan. We have been civil through the whole process. She does not want the home and I agreed to refi just in my name so I have place to live. (the house is upside down by about $100K). I already have been approved just in my name through the same lender. The question I have, living in California do I have to wait till the divorce is final aprox 6 month to have her sign the deed over to me? Can this be done during the divorce process or at closing with the new loan? Is it called a Quitclaim deed? Any help is appreciated.

welcoem to the forum. you can refinance any time as logn as you have the correct lender and right terms.

and she can give you quit claim deed any time she si reayd and it does nto depend on yoru divorce proceess.

just makesure to check with legal zoom personal to make sure you ahve the correct tersm put in your divorce papers, so it shodul not affect both pof you in any way in the future.

I'm also of the same opinion as Realgeni. While you're refinancing in your name, you can get a deed signed by your wife to change the nme on the title. You shouldn't have to wait till the divorce process is over. You can use either a quitclaim deed or a warranty deed for the transfer of property. But a warranty deed would obviously be a better option for you.
