Sign Over Deed to Ex

Hi, i filed BK late 2009. Discharged in March 2010. Now divorcing and should be final next month.

Spouse is currently in the house with my two children. Its been proposed that I sign over the deed to the house to her. Deed in both names, loan in my name only.

Spoke to real estate agent and they (agent) said house MAY not have any equity (based on market) and we have requested a short sale from the bank.

Based on the no equity and short sale proposition, it was suggested that I sign over the deed to the ex.

What are the pro and cons of signing over the deed to soon to be EX-spouse

Welcome to forums!

If you transfer the property to your ex, then you won't remain the owner of the property any more. You will have to take your ex-spouse's permission if you wish to short sale it.
