My son is part of the deed for my house, but is not paying for it. His name was included in the bank loan papers so we could get the loan from the bank. I would like to get his name off the deed, how can I do it?... My husband passed away last year, and I would like to update the deed. The mortgage now is solely on my name, and I would like that to be reflected in the deed as well.
Hi essamonte,
In order to remove your husband's name from the property deed, you will have to file an affidavit of heirship at the county recorder's office. As far as removing your son from the property deed is concerned, you will have to ask him to sign a quit claim deed in your favor. If your son's name is also mentioned on the mortgage docs, then you need to refinance the loan in your name.
Thanks
