is it legal for a deceased person's name to be on a loan even after the fee was paid to take deceased name off morgage?
hi betty_boop,

unless someone else refinances the mortgage in his or her name, the deceased person's name will remain on the mortgage docs. so, the heirs or the co-borrowers of the mortgage will have to refinance the mortgage in their names.

take care.

Betty, I don't quite comprehend what kind of fee might have been paid "to take deceased name off mortgage."

Once a mortgage note is signed by someone, it is effective until that loan is paid in full. One is not able to pay any sort of fee to remove a name. The only way in which such a thing can take place is if any survivor(s) were to refinance the existing loan; with the subsequent note replacing the old note.

As for the legality of a deceased person on a note, there's nothing that would make it illegal.

It wouldn't do me any good (nor you) to point out that you're not alone in your troubles, at least as far as what you seem to be describing as an overweight situation. Obviously, eating a lot of junk food isn't particularly good for you, emina (if that's right). And going from 145 to 167 is pretty substantial in the course of 11 months - that's 2 pounds a month, and you don't want to keep at that, I'm sure.

You say "troubled" - well, most everyone posting here is troubled in some way or another, so you're on common ground for the most part. Let us know if we can be of assistance in some way and we'll be read and willing to help out with tips, comments, suggestions and perhaps even a solution or two.
