I along with my husband are successor trustee's of his parents trust. Both are now deceased; one died 2009, the other 2010. What paperwork needs to be filed to transfer their homeinto our name/trust.
We have filed affidavit of deaths for both. Can we do this on our own or should be consult an attorney.

The concept of trustee is important in case of a deed of trust. If the note is paid as agreed, then the trustee's job is to re-convey the property title to the borrower. If the borrower does not pay, the trustee holds the power of sale. However, I haven't heard about the term mortgage settlor.
