My mother and I own a property together. There is right of survivorship.

she' is concerned that upon her death another family member will try to fight for the property. we already bought this person out years ago. if she does a quit claim deed to me will this protect the property. the buyout was done in a legal manner with full acceptance in an attorney's office. thank-you.
if she does a quitclaim to you then surely you will receive the whole property without doubt.

but you need to confirm that the person (your mother) should posses the property on her name only.it should not be co-owned.

surely it will be helpful if she prepares a deed. :wink:

Hi dmverg,

If you and your mother are on the title and there is a right of survivorship, you will inherit the property after her death straight away. I don't understand how this third person comes into the picture. However, if you think he/she can create problem in future, you can obviously get a quitclaim deed signed by her whereby he/she would be relinquishing all his/her interest in the property to you and your mother, if he/she has any.
