I am looking to switch a rental property out of my name into my father in laws name. I am moving out of the area and the house is a money maker but I will not be able to manage the property any more and dont want to. Is there a way to transfer the mortgage out of my name into his name?

Once you transfer the property to your father-in-law, he will have to refinance the mortgage in his name. Once he does so, you won't remain liable for the mortgage any more.

Hi Phil,

You need to sign a quitclaim in order to transfer the property in your father-in-laws name. After transferring the property your father-in-law needs to re-finance the mortgage in his name. However, the lender will decide whether to approve the re-finance or not. It is better that you speak with your lender before transferring the property.
