How do we switch the Deed to our name?

Posted on: 08th Jul, 2010 02:14 pm
My Grandmother wrote out her Will and listed several of us in it. But she did not sign it or get it notarized. Is the document still legal since it’s in her handwriting?
Also, my Grandmother is not deceased but she is on life support in a coma due to a heat attack caused by her lung cancer and the Doctors don’t think she will come out of it. Is a way we can get the Deed switched to our name?
Hi dblanton!

Welcome to forums!

As the will does not have your grandmother's signatures and as it is not notarized, the document will not be considered as legal or valid. In order to get the deed switched to your names, your grandmother will have to sign the quit claim deed. I don't think she will be able to do so due to her medical situation. After her death, the heirs to the property can file an affidavit of heirship at the county recorder's office and get the property transferred in their names.

Feel free to ask if you've further queries.
