Taking my name off

my mother and i got a house together in 05. she kicked me out in 08. i found out that the property went into forclosure, but then she managed to get it out. then she refinanced it again and tricked me into signing the refinance papers by telling me it was to remove my name. i had a credit chek done last month and found tht im still responsible for this house. how do i get out of it?

If your name is on the mortgage docs, then you are responsible for the loan. You'll have to ask your mother to refinance the loan solely in your name and release you from the liability of paying off the loan. I guess your name is mentioned in the property deed. You can even file a partition lawsuit in order to sell off the property. The court will order a sale. After the property is sold off, the mortgage dues would be cleared first. Any extra amount resulting from the sale would be divided between both of you.
