Tax Lein on property

Posted on: 01st Oct, 2013 06:50 am
My ex wife quit claimed our marital home to me in January 2012. I am in the process of refinacing and the title search turned up a tax lein in her name dated November 2012. Is this lein valid?
Welcome John,

The lien will be considered as valid. You should get in touch with your ex-wife and ask her to pay off the tax lien.

From the information you've provided, the tax lien will be valid. Fact that it's in her name, means she's required to pay it off.

The lien is "valid" but since it was issued after she transferred the home to you, it does not attach to your property.
