removing underage children on a deed

Posted on: 02nd Feb, 2009 07:26 pm
A few years ago my parents went to see a notary and what my parents where looking for was to do a testament where if something happen to them the house would be ours. But instead they signed the house over to us. So now all five of there children are owners of the house as well as they are. They want to remove us as owners. But the problem is that two of the children are 17 and 15. I just don't know what to do to help them. In this case would we need an attorney? PLEASE HELP!!!!

Hi!!

Since two of the five children are minor, I'm afraid, a quitclaim will not be possible by them. In order for the quitclaim to be valid, the grantor i.e. the person transferring the property-interest to a grantee must be an adult. However, I am not a legal expert and I'll always suggest you to contact an attorney for further consultation on the issue.

Take care & be happy.

God bless you all.
