How do you transfer a deed for timeshare from one spouse to the other?

Posted on: 02nd Oct, 2009 03:54 pm
I live in South Carolina. My husband & I just legally seperated. We own a timeshare in Myrtle Beach, SC & one in St. Augustine, Fla. Both are paid for in full.(no mortgage) How do I get the deeds transferred from both our names to just my name on the 2 properties that I was awarded.

you will have to do a quit claim deed

you will need to ask your ex to sign a quit claim deed and make sure it is notarized and record it in the county

this will help you to move the property in your name only

Hi jammiet,

You will have to ask you ex-husband to sign a warranty deed and transfer the property in your name. Once he does so, you would be the sole owner of the properties. As he signs the property deed, make sure you notarize and record the deed at the county recorder's office where the property is located.

Thanks

Warranty deed is a better option as property is free from mortgage.

that there is no mortgage on the property has no bearing on the type of deed to be used.
