My husband I purchased a home in Sussex co Delaware. We closed on the DE property in Maryland and use a Maryland title company9 Marylang only attorney) . The attorney that notarized our document was not present so he did not see us sign and it is my understanding Delaware being an Attorney state that you must have a DE attorney close on DE real property. Is this correct or can a MD attorney close in MD on a DE real esate?

If the MD attorney has the license to operate in DE, then he can help you close a loan/property in DE. if he does not have the required license, then I don't think it will be considered as legal.

I think you should contact the county recorder's office at DE and get to know whether or not they will allow this. The county recorder's office will be able to give you right suggestions in this regard.

What did your Loan Officer say? This should have been taken care of before you signed the loan documents. When I'm closing a purchase, and my clients are out of state when it's time to sign the final loan documents, I seek assistance from my Escrow Officer, to learn the guidelines between the two States, and see if it can be done. Otherwise, we'd end up in the same situation as you.
