we don't know what to do with our mothers house her name was the only name on property.

If her name is the only one on the title and she has left on will, the property will be divided according to the laws of intestacy applicable in state where the property is located. An affidavit of heirship needs to be filed with the probate court for this purpose.

how do you aquire an affidavit of heirship? And can this be done without the property going into probate.
