Title Deed

Hello All,

I have just joined and I have a question that I have been pondering with.

I purchase a home from a first time home owner is lived a newly developed Towne Home for 3 years. In July 2005 I signed my closing papers and the previous owner signed a warranty deed over to me. The was recorded the day of closing.

After two years of living in the home I received a letter from the County stating that the deed was not in my name and that I would have to register to receive the title by paying 35.00. At the time I was a little baffled because I had the original copy of the warranty deed that was signed and notarized in May 2005 with my name listed as guarantee

I did a little research to find out if my name was listed as owner. Not only was my name not listed of ever having any investment but a bank(unbeknown to me) was listed as being the owner of the and recorded on the same date of my closing July 2005 until now.

What should I do? :shock:

It is quite surprising to me that you had notarized and recorded the warranty deed in your name in the county recorder's office but the property is being listed as the bank's property. You should immediately contact the county recorder's office and show them the copy of your deed. You may even contact a legal counsel who can speak to the county recorder regarding your case.

hi sussane!

i thought it seemed suspicious. i did not see this lender on any of my closing documents. as a matter of fact it was not until i filed a dispute that i first notice them as trustees of loan.

is it possible to have a home equity loan if there is isn't equity in the home? well i have a home equity loan with my knowledge. i did not refinance after purchase so i am still a little confused.

Welcome back to forums!

If you do not have equity on the property, then it will not be able to get a home equity loan on it. The lender will not be ready to give you a loan.

Well Home Equity Loan, is my lender and just found out by way of in debt searching. How is this explained?
