What happens when you have inherited a property that was titled to a deceased father, but the widow has survivorship rights and wants to buy out the heirs. Her name is on the mortgage but not the title, which she claims is a mistake. She has other properties that she owns and might want to walk away from this one house? Any advice..Can liens be put on the property to try to get you to sell?
Welcome Rose,
As the widow's name is not mentioned on the property deed, she cannot legally claim the property or force you to sign the deed in her favor. If you do not wish to give her the property, you should let her know that and refinance the mortgage in your name. This will make you the owner of the property as well as the mortgage.
