title deed and death of co-owner

My brother (married) and I (single) are on title to my condo. I have been responsible for all payments (mortgage, maintenance etc.)

The title deed states - David Bush and Dan Bush husband of Kate Bush

My brother suddenly passed away with no will or power of attorney document made.

I want to sell the condo, do I need to do anything to sell? What about his wife?

Portion of your brother will be considered as marital property & his wife may become coowner of property.

Has your brother paid for down payment or monthly payment in past?

Welcome to forums!

You cannot sell off the property without removing your brother's name from the property deed. Your brother's wife or you will have to file an affidavit of heirship and remove your brother's name. Then sell off the property. If your brother's wife is the heir to your brother's property, then she can claim a certain portion of the sale proceeds.
