My two sisters and I own the old family homestead in joint tenancy with rights of survivorship. They verbally agreed to let me buy out their two-thirds and are now backing out and trying to sell the property to another person who has offered them cash and $40,000 more than the current appraised value, and claim they can do it without my consent or signature. I can get financing and have recently been forced to sell my home of 22 years because of a divorce. They refuse now to sell to me. Can they sell their 2/3 interest and the new owner force me out if I move in the home now?

Your sisters can sell their portion of the property to someone else. However, they won't be able to sell your share of the property without your permission and signatures. I know my two sisters can't force me to sell, but once they sell their 2/3 interest it breadks the joint tenancy and the new owner and myself would become tenants in common. Because he would own 2/3 interest, could he force me out?
