My mother died 2008 leaving me the only one a life estate in her home. Unfortunately ahead of her passing away my older sister moved in changing her will giving her a life estate. I am now fighting in court to be paid for my life estate being a constructual eviction occurred. Would my mothers age she was 91 increase the value of the life estate
Hi chaskins
I think your attorney will be the right person to comment on this. If your mother has given the life estate rights to your older sister, then she will have the right to stay in the property. As far as age is concerned, I don't think it would be considered as a factor to increase the value of life estate.
Thanks.
