Warranty deed transfer after divorce 6 yrs later

Posted on: 14th Oct, 2009 07:19 am
I have been divorced for 6 years .Now my ex found out that his attorney never filed the paper work to have my name taken off of the warranty deed. I gave him the house in the divorce. What are my legal rights? They are asking me to go to a notary and and have a paper notoraized , and send it in. I live in another city. He is trying to refianance the house.
Hi sherrio,

If your ex-husband wants to refinance the loan in his name, then you will have to remove your name from the property deed. This will make him the sole owner of the property as well as the mortgage. You can sign the quitclaim deed in his favor and he can notarize and record the deed.

Once you sign the quitclaim deed, you'll lose your ownership rights in the property.

Feel free to ask if you've further queries.
