quit claim or warranty deed?

hi my husband and i are getting a divorce, are house is pay for. is a quit claim deed a good choice or a warranty deed? i am buying him out. will he have any thing to do with the proptery after this is done.i want the house as if i bought it my self.is that possible suzanne

You have mentioned that the house is paid for and you want to buy out your husband. In that case, I think a warranty deed will be a better option than a quitclaim deed. Once you buy him out and the new warranty deed is recorded at the county recorder's office, then your husband will have no claims on the property. While drafting the warranty deed, it will be better if you can take the help of an attorney.
