Can we use a warranty deed to add spouse to title with a mortgage...Hi, my husband purchased our in Sept of 08 and we were married in Oct 08. I understand Texas that is a community property state, however, I still want to be listed on the deed so that I can handle legal matters, etc.

I was told by the FBC tax office that a Quitclaim deed is virtually useless and they suggested that I use a Warranty Deed. My question is can we use a Warranty deed with him as the Grantor and us as the Grantees even though there is an an outstanding mortgage?

yes, you can use a warranty deed to add your name to property along with your husband. as there is a mortgage on the property, i would suggest you to inform the lender before adding your name to the property. may be he will ask you to refinance the property.

does the spouse being added to title during a refinance have to sign deed, notice of right to cancel, TIL an Itemization. I do an occasional loan in Texas and I know these items are needed in Nevada, not sure about Texas...
