Can a warranty deed be made void if a person gave land to someone else when she had gave the land to another person.

My mother in law gave five acres to my husband and I with rights to live there until her death. I have found out she gave three acres of that five to my husband's brother and wife, without us giving that three acres back to her. She has passed and we did not know this until recently. I still have the original deed showing the five acres were given to us.

If the property was originally transferred in your name and your husband's name, then your mother-in-law cannot transfer the same property to someone else. If she does so, the deed won't be considered as valid. I will suggest you to contact an attorney and take the required actions in this regard.
