my ex-wife back in 1996 was approached by her daughter telling my ex-wife that to be able to keep from losing her home, that she was to sighn this document, and that they can't take ger home away. she didn't know that this was a quitclaim. in 2009 my ex-wife was strickened with cancer, and she asked me to take her to a lawyer to file a will. in this will she left the homs to her younger daughter. then she found out that she sighned the quitclaim to her older daughter. when she found this out, she went to the daughter and asked to get her home back as to she was not told that this was a quitclaim. she sighn a paper stating that she was not aware that it was a quitclaim and had it notorized. she was paying all the taxes and had the home insurance ,which was stlii in her name. the insurance company issued a check of $ 77,000.00 to the you. now the older daughter is trying to get this ins. check. the reason that the check went to the younger daughter is that thru the will, all of the estate was left to the younger daughter. my ex-wife died about 8 months after this all came to the surface. question. is the older daughter entitled to the home and the ins. check?
Hi eakas,

As the quitclaim deed is in the name of the older daughter, she has the rights to the property. However, if the younger daughter can prove that the older daughter forced your mother to sign the quitclaim deed and did not give her proper information, then she may be able to claim the property.

Thanks
