A parent of three grown up children , (all are settled in life) has made his will as a gift to one son only ignoring the other two nor without concent of them also, and this was done while he was not in normal health with poor vision, the beneficiary took himn to lawyer ,prepared the will and the parent had signed without being able to read the document and he was not aware that the document was prepared on selfish motive. The survying ddaughter is victimised. What is the remedy? The parent is no more now? and the the son who did all thease is enjoying. What is the remedial action on this fraud?
Hi ramanujam,
In my opinion, the surviving daughter will have to prove it in the court that her sibling has committed a fraud and transferred the property in his name. She should take the help of a real estate attorney who may help her know what steps she should take in this regard.
Thanks
