My mother in law put my husbands brother on her deed to her house after their father died because she thought that is what you should do. Her will states that everything is to divided evenly between the siblings. Now there is some question as to whether the house would be part of the will since only one of the childrens name is on the house and when she dies it will be solely his. Will the house be included in the will since his name is one it only?
Hi Betsy,
Though the brother's name is mentioned in the property deed, it can be included in the will. Your mother-in-law can will her share of the property to your husband. However, for further advice on this issue your mother-in-law can take the advice of an attorney.
Thanks
