my stepfather died a week ago. my sister was staying in his house when he died. she is 45 years old and had moved back home due to financial crap. my mother had a 20 year old will, that had named my brother who died in nov of last year as owner of everything, if he died my sister was next in line. my step dad had l00k llife insurance and now they are saying that it will go to my brothers estate first to his wife and then to my sister. so i assume it will be split 50-50. even though my brother is dead would this be true? this is what my sister is telling me from her attorney, i am not named in the will but she says it would be divided 33-33-33 between me, her and my sister-in-law. there are so many hokey things going on right now that sounds like two completely different things to me. i assumed when my brother died he dropped off of the will. he has no children. thank you anyone out there for some advice.

There should be legal paperwork which states that after your brother's death, part of his property would pass on to his wife. If no, then the wife needs to file an affidavit of heirship so that your brother's property is transferred to her. The wife can then transfer it to anyone or add anyone to the title as and when she wishes to.

After the death of your brother, the Life Insurance will go to his wife. And if she wishes, she can add your name to it. Otherwise as you are not named on the will, I think you will not have any right to it.

Your stepfather's property will been changed to your mother legally.
