Posted on: 05th Apr, 2010 05:52 am
My Dad has signed a warranty deed to me for the homplace with 40 acres now he has made a will out and he has split the land 20 acres a piece between me and my brother will this will override the warranty deed he made me three years ago?
Hi bpalsa!

Welcome to forums!

If you're the sole owner of the property as per the warranty deed, then it will override the will that your father has drafted now. Your father won't be considered as the owner of that property any longer and thus, he will not be include your brother on that property.

Feel free to ask if you've further queries.

we live in the state of Fl, and my husband and I own a home. Both our names are on the deed, if he died would the home go to me or his two kids from another marriage ?

Welcome Guest,

The two kids from your husband's other marriage will also be considered as the heirs to your husband's property. They can claim his share of the property.
