My husband and I are feuding. (in a loving way). Please answer this question. Note on house is in my name only along with the loan docs. The Mortgage is in both names as Joint Tenents. My husband states because his name is on the mortgage he is equally liable. I think because his name is on the NOTE which is the actual promise to pay he is not liable. Home is in SC

As far as I know, if your husband's name is mentioned on the deed of trust, then he would be liable for the mortgage dues. You and your husband should check out the mortgage docs carefully and check out whether or not his name is mentioned on the deed of trust.
