Quitclaim deed and abandoned property

Posted on: 10th Nov, 2007 05:52 am
I, foolishly, signed a quitclaim deed with myself and two other people on some property. Both of those people have moved off the property and are not able to be notified. Is there some sort of way to claim abandonment to get them off the quitclaim deed? The property has been on the market for over a yr and is in the process of foreclosure. I would not be able to sell if I had an offer as they are not available to sign papers.
Well i understand your problem. You can try to locate the persons who left through the leading newspapers if that's possible for you. or else, you can force the sale of the home through partition lawsuit. Better talk to an attorney in this regard.

Hello Connie,

The co-owners' signature is required at the time of selling the property.

But if you cannot locate them, you can sell your property by a partition lawsuit, if there is no actual defense to the partition.
