removing a deceased name and adding a childs name on quitclaim deed

My mother and father got in a horrible car accident and my mother died. They have their house paid off. Now my father wants to remove my mother's name and add my name and my brother's name to the deed so if he passes on the state will not take the house and we won't need to pay inheritance tax.

Where do I find Massachusetts quitclaim form? The ones for sale on ebay for example, trick you to fill out fields and then tell you it will cost $900.

Can I do this without an attorney?

Can you give me what steps to take.

Hi anthouladas,

Your father will have to file an affidavit of heirship at the county recorder's office in order to remove your deceased mother's name from the property deed. Once he does so, the property will be transferred in his name. He can, then, sign a quit claim deed and add you and your brother to the deed. Your father will have to contact a real estate attorney and he will help him in drafting the deed. It'll be better to take the help of an attorney in order to draft the deed.
