Quit Claim Deed-Adding a Spouse

Posted on: 15th Feb, 2013 10:27 am
hello...my husband and i recently married and did a quit claim deed to add me to our house title. i am not on the mortgage. should something happen to him, am i responsible to make mortgage payments. i understand that it is my responsibility as grantee to make property tax payments, but what happens with the mortgage on the property? thank you!
Hi Anne,

Unless your name is mentioned on the mortgage docs, you won't be considered liable for the mortgage payments. The lender cannot come after you for the payments but he may sell off the property to recover his debts.

Thanks

You are on the title of the property. It does not mean that you are on the mortgage. As you have told, since your name is not on the mortgage, you won't be responsible for making mortgage payments.
