My husband and I want to quitclaim our 1/2 interest in a property we own with my brother and his wife. we want to give our 1/2 portion to my mother. What is the proper wording I use on the quitclaim? My mother is married to my father. Do I list her as a married individual? I don't want to include my father on the property.

Do your mother live in a community property state? If not then you should not have problem to transfer the property to her. If you don't mind, I would like o ask whether they are divorced? If there any lien attached to the property?

we are in california, community property state, yes, they are married. There is a small mortgage on the property (50,000), and no liens. the loan is held my and my husbands name and my brother and his wife's name. My brother plans to pay off the loan once our names are off the property. We are just unsure how to word the parties names on the quitclaim. Do we quitclaim our portion to my mother only or do we list her name and my brother and his wife's name as joint tennants?

If your mother stays in the property, and you wish to add her name to the title, then you can list her name on the quitclaim deed along with your brother and his wife as joint tenants with right of survivorship.

is there a loan on the property? if not, you can add the name on your title with a quit claim deed.
