Is a quit claim deed valid between married partners?

Posted on: 14th Feb, 2008 07:44 am
my husband and i own a parcel of land outright, no debt on it. for valentine's day, he signed a quit claim deed, in effect "giving" me the parcel. is it legally entire mine? does he retain any ownership or claim to it at all?
It is now yours completely. Make sure you record a copy of the deed in the county recorder's office where the property is located.

Happy St. Valentine's Day

Hi Julie,

Welcome to the forum.

If your husband has quit claim to only you then you are the sole owner of the property. But if he has quitclaim to you and himself that means he has added you in the deed and made you the join owner of the property.

Have notarized and recorded the deed? If you have not done it yet, do it ASAP to make the deed valid.

Feel free to ask if you have any further questions.

Thanks,
Larry
