i refinanced my home and added my spouse. the home is now in both are names. we are now getting a divorce. he is not contesting anything and agrees that i will keep the home. will a quit claim deed be the right choice? who is the grantor? the title is in both our names. mine as the primary, his as the secondary?
Yes he will transfer ownership back to you. You need an attorney or title company to do it for you.

If he is on the loan then he is responcible for the loan and you can be ordered to refinance in just your name by the judje ( if you keep the current loan current lender should have no problem althouh they have the right to call the loan due or ask you to refinance if and when they find out about the situation) If the loan is in your name only then all the husband needs to do is to sighn the quitclaim deed to remove himself from the title wich will relinquish his rights to the property. (check state laws and talk to your attorney on the matter)

If your husband does not have any interest in the house, then he can use a quitclaim deed and transfer his share of the property over to you. In the deed, he will be named as the grantor and you will be the grantee. By signing over the deed, he will give his rights to the property and the entire property will get transferred in your name.

Hi,Evon, though your husband didn't contested with you and he voluntary give up the house ownership to transfer the part of estate of ownership by him. So, that means he used a right about quitclaim deed. and he was as grantor ,you were grantee. The house ownership will completely belong to you.
